If you return the fake to the seller before getting your refund you could be in bigger trouble as you'd have no evidence for your claim.

Just did a bit of research and it looks like I am going to go ahead with this using this service.
First going to wait till the new year and then going to send a recorded letter to the person requesting a refund within 14 days yet again. If no refund within 14 days I will go ahead and make the claim.
This could also come in useful for some other cases I have had in the passed which I may be able to get money back for.

Don't know the cost to lodge off the top of my head, but do know that if you win you will be granted costs (i.e. the other guy has to pay your fees).
