    yes be me in my home, but not once sold to the buyer,

    Did the buyer sign anything to prove acceptance of the item in whatever condition it was sold and did you keep a copy of his/her receipt as proof?

    would you expect that to be neccessery, at a hand over where the buyer looks at the item, before payment in cash,

    had anything been wrong with it, they could just have refussed to pay, and walk away,

    true, it was mention be me to high light the fact, its not just on BINs,


    second respose,

    the rules relate to items being sold (buy it now). This discussion isn't about auctions and face-to-face selling, it's about distance selling

    and as I said, IT DOES NOT APPLY TO JUST BINs,
    which is why I brought it up, it applys to ALL on line auctions,

    If you are selling goods of any description, it's safest to check with the OFT what your and your buyers' rights are. Perhaps I'm overlooking the fact that not all sellers are having to log receipts of all their actions and auctions for tax purposes. Here's a handy link to the OFT anyway. If nothing else, it makes interesting reading material for some people.

    took a look, and what do I find,

    Exceptions to the regulations
    The regulations do not apply to:

    financial services
    sale of land or buildings
    purchases from a vending machine or automated commercial premises
    the use of a public pay phone
    auctions, including internet auctions



    INCUDING INTERNET AUCTIONS,,


    so you see even they cant get it right,

    is there a difference, if there is, why mention, ebay, ebid, and the others,

    The internet auction giant - together with eBid, CQout, QXL and Tazbar - will now include advice and links to inform consumers of their rights under the Distance Selling Regulations (DSRs).

    Yes, informing consumers that they are still covered by the same (or similar, whichever you prefer) regulations and protections offered through other forms of mail order/distance selling when buying online. If it can be bought 'now' without bidding, then it isn't classed as having been bought at auction. That's how I have always read it, anyway.

    Yes, informing consumers == read buyers,

    Like all government legislations, it down to interpretation,
    And I take it that ALL ONLINE AUCTION are to be exempt, ONLY A VENU,

    But I was proved to be wrong, IE my SCC, judgement,
    As the judge saw it differently,

    May be he was wrong, who am I to say,

    Sorry QC but you have me confused. You sold an item for cash, handed it over in person but it was an online auction? Did they do a 'buy it now' and then come & collect it? I thought you meant an auction room sale. Yes, I agree rules are confusing, but I find it's always safest to read them with the 'worst case scenario' in mind. Like, I have just had to update my eBid 'about me' terms & conditions section because I had inadvertenly written '7 days' for the cooling off & returns clause instead of 7 working days, which can be close on a fortnight if the buyer 'buys now' on a Friday afternoon.
    This made me think about the speed some people leave negative feedback on here. Technically, it shouldn't be allowed until after 7 working days of receipt of the invoice etc and, likewise, if no invoice or communication from seller is received within 7 working days then the sale should be dropped/winning bid withdrawn automatically. I never pay for goods from a stranger until they have contacted me and I have all their details. If they are regular customers, then I don't even wait for payment to arrive a lot of the time.

    ebay, winning snipe, paid cash when collected,( said that in the thread )


    but none of this changes my first reply, it would be a get out for any reason
    within 30 days,

    but my other point, seller protection, when they know they are being screwed,
    whats comming out of this, repay and be crewed, regardless,

    even invisable marking, cant get you protected, buyer just has to say you removed it when item was returned,

    sellers could be on a real hidding with this DSR,

    on the auction sites,, you are requested to put a BRIEF description,
    with pictures, ( if you want to )

    even that want help you when bidders DONT READ or look at the pics,
