    Default Housing!

    I am under a 50/50% scheme with a housing ass. That means I own 50% of the house and they 50%. Now we want to move but cant afford to buy outright so I ask the Housing ass to move with us but they wont! so It means we a stuck. Surely this is not right? I want to challenge them. We have paid our rent on time every month for the last 13 years! Really frustrated.

    Now far as I know, the only way you can move is if they buy your part of the share, and then you wont get alot due to the fact that they own half of the property. And whatever they give you wont be enough to get you another place without openeing up another mortgage.
    You could try and go to Council, but whatever proceeds you are given towards the sale of you half Council may not consider you homeless, they would say go rent privately on what you have. I think you may need to go to citizen advice bureau, or ask to see a solicitor, if you are in reciept of certain benefits, you can get a certain amount of advice from them free. Not sure if they can help you all the way though.

    I think you may have to get a whole mortagage to buy out their share unless you are going for another schemed house but not sure.

    good luck though

    im getting made homeless soon due to tax credits yet again. Not only have they forced me out of work now they have now neglected to pay me on time for the past couple of months so im in arrears and being faced with an eviction notice and no promise of when they will pay me the arrears they owe me....great isnt it

    Who hasnt paid you Voddie, if its the Council who help pay your rent etc you can get a court order to stop the eviction, or if the council owns the property & the rent isnt being paid then they cannot evict you until they have sorted out their probs. I know it may be long winded, but if they make you homeless, then you can take them to court and sue them. SO any paperwork keep close at hand. Anything you send to the do recorded and keep a copy.
