Whoever selected the implants may well not be negligent.

In a previous life I worked as a Quality Inspector of products for the Aero Space Industry.

If the documentation supplied by the manufacturer was in order (certificates of conformity) then why should the end user have any reason to suspect the product was faulty.

Well and good for the clinics to cover their responsibility.........which I'd say it was.........but I heard one lady on tv say the clinic she used is no longer in business...............that adds to the problem.
