Interesting...is this the same company selling Monster cables? If so, they sell, for example, HDMI cables for $50 which you can buy the same exact thing without the Monster name for $5. And funny is, some people are so clueless they buy them believing they're better just because they're a lot more expensive.
We had a similar scenario on feebay. They removed an iPod listing because of image copyright!! That same image was using by hundreds of other sellers. Some companies are nonsense in these matters.

Can I just say how refreshing it is to see somebody pursue something like this with the real culprits, rather than just assume it's all eBid's fault? Well done you - I look forward seeing how this unfolds.

Well I contacted Monster legal, they have yet to reply to my second e-mail. I'm sure they will try to sue me. I wonder if I open the box, confirm the serial number on beatsbydre.com and post that screencapture, they will finally let me sell it - one at a time, and used. I am pursuing other avenues, because I refused to eat the loss and have 20 sets of headphones sitting on my shelf.

I was very cordially with eBid, as they were with me. They even refunded my feature listing cost. I never blamed it on them, I knew right away it was Monster.

I still disagree with them (Monster), I didn't violate any copyrights/trademarks. I would be violating them if I tried to pass off fakes, which is not what I was doing. They said their "investigation" leads them to belive I am selling fakes. Since I am selling real merchandise (with the receipt), that I paid for from an authorized dealer, they really don't have a leg to stand on - but they scare eBid and eBay, so I get delisted. People do this all the time, buy something on sale, or from other sites and sell it for a small profit --- hell there are still plenty Beats by dre studio headphones listed on this site, and feebay that are OBVIOUSLY fake...I think Monster is targeting me because they know they are real.

Belief is not the same as proof. While they are free to believe what they like, if they communicate that belief as fact (e.g. they told eBid you were selling fake goods), then surely that is defamation / libel at the very least.

Monster are obviously trying to protect their other retailers and their "monster markups"

It is well accepted that those high-priced HDMI gold cables are a rip off.

What about listing them as used, but un-opened in the title ?

ELDAWSON: Good on you Edward! Stick to your guns cos you've obviously done nothing wrong. And I totally agree with Astral's comment (#15).
