Thread: Bought item but seller will not ship or give refund

Yup, now the ball is in her court and she has to explain her actions.

Obviously her email works, obviously she is still minding her store, but is not explaining or answering your questions yet. If the items were shipped and lost, surely the automatic refund should have come to you quick as a bunny. Surely if she had no stock, she was able to contact you in these last 4 weeks and let you know that fact and again, issue a refund.

Sometimes it takes a hard dope slap to get someone's attention. The saga continues.

    Cool The saga continues...good grief!

Please read my previous posts to get a picture of this story. And thank you to all who have given me advice...it all has been very helpful!

As mentioned before, I never heard from the seller since I paid via Paypal on December 19 (almost 1 month ago.) I contacted her several times inquiring about my items, and certainly she had been contacted twice by Paypal after I filed a dispute on January 8, and a claim on January 11 (Paypal is still waiting for her response.) After I gave the seller 3 negative feedbacks several days later, and eBid closed the seller's account, I received this email from the seller:

"hi, your package was returned to me opened. the liz clutch was gone but the other items were there as they were larger and in a seperate bag. do you want me to refund you the price of the clutch and reship the rest?
i would appreciate it you would do something about your feedback. they have closed my account because you left three. seeing as i had 100% positive feedback i am extremely upset by this.
i am no more responsible for the postal service and their errors than you are. i also need you to do something with paypal as the post office is not open again until tuesday."

Does anyone smell a few rats in this? I try to see people as honest, but this is getting real difficult.

In her auctions, the seller states, "All items shipped with delivery confirmation." Doesn't this mean I would have at least been emailed with tracking info? She never even contacted me that the items had been shipped!

If an item had been opened, wouldn't the post office have still shipped it to me with a note that it had been opened? At least that is what they did when a letter had been accidentally torn by the machine.

How can Pokemon cards be larger than a clutch purse? (read her comment about the larger items being there.)

And the big question is: If I don't allow her to ship the remaining two items as she has offered (I just want this to end and we both call it a day...I've already missed the opportunity to give these items for Christmas, then a birthday), might Paypal decide to NOT refund my money fully because they might see this as being uncooperative?

Should I not respond to her until I hear from Paypal? She wrote the above note through personal email, so it is not on Paypal's records, nor on eBid's. (this was my error in the beginning...I had read her "about me" page, clicked on something to contact her, and it was sent through personal email. Thus, we had some friendly chit-chat until I paid...then there was silence.)

Thanks for any more input, and for taking the time to read all this.

If she shipped using delivery confirmation, it [DC#] should have been entered on the paypal site [I do it for my customer's sake and per paypal's requirement of tracking]. And yes, I believe the USPS would have delivered it had it been open.

I would leave the case open with Paypal. It's the seller's responsiblity to provide tracking. Do you want the other items minus the clutch?

Oh, more more thing. I would not be contacting her via email at this point. Correspond through ebid's system or better yet Paypal.

Thanks, Ginny for your quick response. No, I don't want the two remaining items as they were supposed to be Christmas presents. When I didn't get them in time for Christmas, I figured I could give them for a birthday present on Tuesday. It's too late for that, too. They just aren't that important anymore, and I know I could buy them elsewhere (Pokemon cards and a Harry Potter book.)

I DID figure out how to contact her via eBid, so the last several emails went through that route. I disliked giving her negative feedback (at least at this point), but that was the only way I could get eBid to check into this. I didn't know if she was pulling this on other people.

Well, I guess at this point, I'd ask for the delivery confirmation #. That way you can look it up on the USPS website to see if the package was shipped when she stated and was returned to her. If that's truthful, I suppose I would ask for my money back - full refund - and then let ebid know what finally happened and let them make the final decision. Hope this helps.

    Cool It just doesn't end!

Anyone still interested in the neverending saga of the seller from Florida who never sent 3 items, and never contacted me UNTIL I left negative feedback? And, of course, now she has left negative feedback for me that is utterly untruthful.

I know my notes are lengthy, but maybe they could be turned into a tutorial someday...

I would contact support and if anything can be done about the feedback.
