    For those that want to claim money back I am afraid you will not be able to do it.I bought adobe photoshop elements from a seller when I received it there was a licence number in the letter so I thought, however I emailed the seller and explained to me that he would try to sort this problem out and gave me a further 2 numbers. Both did not work. I have tried to email the seller and have threatend court action as he is selling software was not sealed in the proper package,(meaning it was sent in a plain dvd box, when it should have been in a sealed box with correct licence number UNOPENED). I have tried to claim back from paypal and this is the answer they give you "Quote"
    You have chosen to escalate your dispute to a PayPal claim. By ending
    communication with the seller, you are asking PayPal to investigate the
    case and decide the outcome. As part of our investigation, PayPal reviewed
    any communication you may have had in the Resolution Centre.

    Our investigation into the following transaction is complete. As stated in
    our User Agreement, the claims process only applies to the delivery of
    goods. It does not apply to complaints about the attributes or quality of
    goods received. Therefore, we are unable to reverse this transaction or
    issue a refund.

    So Folks be aware of what software you buy on any auction sites. Make sure it is sealed unless stated, and it comes with a licence

    The seller's name has a strike through, and he has no auctions running. Looks like eBid agreed with you.

    It's unfortunate about PayPal, though. I read about this on another thread, it appears their "Buyer Protection" isn't worth anything. So your warning about buying software online is worth noting.

    I use Google Checkout when it's an option, because I can dispute something like this on my credit card.

    As of the 1st of June 2010 paypal covers off ebay items for "not as described" as well as "not received"

    Only if you are in the U.K. It specifically excludes buyers registered in other countries.

    Maybe someday we'll get it changed here. I'll stick to Google Checkout until then.

    Always been this way. Can't seem to get their heads around unusual circumstances, so they hide behind claiming that protection means making sure package gets to buyer and dictating how that is to happen. Excludes if it is the wrong item, if it is nonworking, if it is missing parts, if buyer mails back empty box etc. OP's item is as useless to him as a broken item, yet it ain't covered.

    Another member said this will change on June 1 but only in UK. Your consumer laws are tougher. In US with ours enforced by each state, we will probably never get any coverage beyond what we have already!

    lipreader, If your PayPal purchase was funded by a credit card I wonder if you could claim against your credit card? Tony

    It appears you have been conned by a bad seller - all paypal have done is stand by their user agreement.

    contact adobe and tell them all about the seller.
    you can also try a complaint to the FSA ( if PP are still regulated by them )
    it can be very effective and costs you nothing - but it will cost them a lot
